WHAT ARE THESE TERMS AND CONDITIONS?

These terms and conditions (“Terms and Conditions”) govern the Promoter’s competition giving you the chance to win a Chad Reed hand-signed helmet and jersey By entering this Competition, you agree to be bound by these terms and conditions. You should read them carefully, and we recommend you save a copy of them for your reference.

WHAT IS THE PRIZE?

A- 1 X hand-signed helmet and 1 hand-signed jersey from Chad Reed

B- One winner will win both items

C- The helmet and jersey are random sizes

D- Cannot be exchanged for cash or credit

E- The Competition opens at 9:00 am (AEST) on 25/1/2024 and closes at 01/04/2024 (11:59 AEST)

WHAT ARE THE CONDITIONS OF ENTRY?

There is no charge to enter the Competition and the usual Internet connection charges payable to your service provider and/or Telephone Company.

To enter this Competition, you must: be aged 16 or over (parents can enter for under 16-year-olds)

You are not eligible to enter if you are an employee, or partner or immediate family member of an employee of the Promoter or any third-party company or agency directly connected with the creation or administration of this Competition.

WHEN WILL THE WINNERS BE CHOSEN?

This is a game of chance and winner will be selected randomly. Using number generator.

The Promoter will attempt to notify the winners using the contact details provided (Via email or phone) at the time of the entry. Should the Promoter be unable to contact the winner, or the winner has not identified themselves as the winner from notification given by 5 pm on 20/03/24, the Promoter reserves the right to forfeit the prize, repeat the selection process and choose a replacement winner

You agree that the Promoter will use the contact details you provided as part of your entry to contact you in the event you are selected as one of the winners.

If you are a winner, you will be required to participate in publicity in connection with the Competition. You agree that we can use your name and photo on social media as ‘the winner’ and off-line in all media and press releases about or reporting on the Competition, the Event or the Promoter.

By entering the competition, you agree to become part of our database and receive communication from Peter Stevens Motorcycles via email and SMS, upon first communication you can choose to ‘opt out.’

By entering the Competition, you agree to your personal information being used for the purposes described in these Terms and Conditions, including the purposes of assessing your eligibility, administering the Competition, prize fulfilment, and for contacting you if you are selected as a winner.

ADDITIONAL TERMS

By participating in the Competition, you hereby warrant that all personal information submitted by you is true, current and complete and that the e-mail address you submit is accurate and valid.

Any entry made or attempted to be made in a manner which in the Promoter’s reasonable opinion is contrary to the spirit of these Terms and Conditions or by its nature is unfair to other entrants will be invalid and may result in your disqualification from the Competition. Examples of entries or behaviour which are not allowed include fraudulent entries, bulk entries, automated entries, cheating, hacking or deception.

Subject to any written directions from a regulatory authority. The Promoter reserves the right to cancel the Competition or amend these Terms and Conditions at any time without prior notice in circumstances beyond the Promoter’s reasonable control where the Promoter reasonably considers such cancellation or amendment is unavoidable.

The winner acknowledges that all intellectual property rights belonging to the Promoter, such as but not limited to the Peter Stevens Motorcycles logos, as well as the intellectual property rights of its partners and sponsors and any audio, visual material produced containing images of the Competition winners are and shall remain the Promoter’s sole and exclusive property or its partners or sponsors.

The Promoter cannot accept any responsibility or liability for any injuries, damages or death caused by prize

The Promoter cannot accept any responsibility error, omission, interruption, deletion, defect, delay in operation or transmission or mail delivery, communications line failure, theft, destruction, corruption, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

The Promoter shall not have any liability and does not accept any responsibility for any damage, loss, or injury at the event

In the event of any dispute, whether such dispute concerns the conduct or eligibility of participants, results or any and all other matters relating to the Competition, the decision of the Promoter shall be final, and no correspondence or discussion shall be entered into.

Entry is only open to Australian residents aged 15 years or over. Entrants under 18 year of age with parental consent.

Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Entries into the promotion open on 12:01am 27/07/23 and close at 11:59pm AEST on 10/09/23 (“Promotional Period”).

Participating in the Competition takes place by:
a. visiting the Peter Stevens website (“website”), follow the prompts to the promotion entry page, input the requested email address and submit entry form during the Promotional Period.
b. scanning the QR code at any Peter Stevens store, follow the prompts to the promotion entry page input the requested email address and submit entry form during the Promotional Period.

Only one (1) entry is permitted per person.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

Incomplete, indecipherable, or illegal entries will be deemed invalid.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The draw will take place at Peter Stevens Motorcycles Pty. Ltd. 5 Mosrael Pl, Rowville VIC 3178 on 15/09/23 at 10:00 am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified in writing via the email provided in the entry form within two (2) business days of the draw and will be published online at https://www.peterstevens.com.au/competitionwinners on 20/09/2023. Winners selected at random.

The Promoter’s decision is final and no correspondence will be entered into.

Winners are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by a winner be incorrect.

Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

The Competition provides for a chance to win a prize. There will be 3 prize(s): 1 of 3 hand-signed Daniel Sanders GASGAS gear combo. 1. Hand-signed GASGAS Helmet, signed Fox jersey and $500 in-store voucher. 2. Hand-signed GASGAS Helmet, signed Fox jersey and $250 in-store voucher. 3. Hand-signed GASGAS Helmet, signed Fox jersey and $150 in-store voucher. In-store voucher terms & conditions apply. The winner(s) will be selected in a random draw to take place by an independent person or by a computer process at the Promoter’s premises on or around 2 days after the close of the Competition Period. Promoter will notify and instruct winner(s) how to claim a Prize by email to the email address submitted within 7 days after the draw regarding acceptance of a Prize. Limited hand-signed helmets and hand-signed jersey sizes available.

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

A draw for any unclaimed prizes may take place on 28/09/2023 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing via the email provided on the entry form within two (2) business days of the draw and their names will be published on the website https://www.peterstevens.com.au/competitionwinners on 28/09/2023.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.
